Legal fees

These are determined by the value of standard single-dwelling property and in order to assist you the following table sets out our current fee structure. All fees are exclusive of VAT. No property is exactly the same, as our fees will reflect the particular requirements of your sale or purchase. For example, dealing with a listed building may, because of the added complexities, cost more than dealing with a new freehold property

We strive to ensure that you have the best possible information about the likely overall cost both at the time you instruct us and, when appropriate, as the matter progresses.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. For example, in leasehold matters, there are certain disbursements that will be set out in the individual Lease relating to the property. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements will apply depending on the terms of the Lease. We will update you on the specific fee on receipt and review of the Lease and leasehold information pack from the seller's solicitors.

Stamp Duty Land Tax The amount of any stamp duty land tax is dependent upon several factors including the price of the property, whether the buyer already owns another dwelling (whether in the UK or elsewhere), the type of buyer (e.g. whether an individual or a company or a trust) and so on. It is a complicated area of law and you can get a guide on how much stamp duty land tax you will pay on your purchase by using the calculators on the HMRC website.
Land Registry application fee The amount of the registration fee payable will vary according to the value of the property and nature of the transaction. If you are taking out a mortgage at the same time as buying the property then the fee will also cover the application to register the mortgage
Electronic money transfer fee (per payment) £15 plus VAT
Electronic money transfer fee(overseas) £65 plus VAT
Electronic bank account check (per check) £10 plus VAT

Additional disbursements in relation to a leasehold property (Fee payable to the landlord and/or any management company to notify it/them of a change of ownership of the property)

Notice of Transfer fee (this is a registration £50-£150 plus VAT per Notice. The (minimum) amount of this fee is usually set out in the lease.
Notice of Mortgage fee (this is a registration fee payable to the landlord and/or any management company to notify it/them of a mortgage over the property) £50-£150 plus VAT per Notice. The (minimum) amount of this fee is usually set out in the lease
Additional leasehold documentation e.g. deed of covenant or rent deposit agreement or licence to alter (if you plan to carry out work to the property). Note – it is usually the seller who pays the landlord’s costs for any consent which is required to the sale of the leasehold property but the buyer would be responsible for the cost of notice of transfer and charge If additional leasehold documents are required the costs vary widely between landlords and/or management companies and could be anything from £250 to £1,250 (or more) plus VAT depending on which documents are required and also if there are landlord’s and/or management company’s legal and/or surveyor’s costs to also pay.

Our Fees Assumptions that;

  • Fees are quoted exclusive of disbursements, and assume the property is a single registered freehold title of a single residential dwelling;
  • On a leasehold transaction, this is an assignment of an existing lease and not the grant of a new lease;
  • The transaction is concluded in a timely manner and no unforeseen complication arise that requires additional work; and
  • No indemnity policies are required.

Exclusion and Adjustment where additional fees may apply;

  • The property is a new build or under construction;
  • The property is a listed building or within a listed building;
  • An extension or entering into a New Lease is required;
  • There is a retention;
  • It is a first registration of title;
  • There is a shared ownership scheme;
  • You are using a help to buy scheme;
  • You are using a help to buy ISA;
  • You are purchasing under the right to buy / or by way of Assignment;
  • You are purchasing at auction;
  • The property has been repossessed;
  • If your mortgage lender instructs its own solicitors;
  • You have a second mortgage/charge/charging order; and
  • Fees on sale when we act for you include dealing with the discharge of 1 legal charge for a lender;

Our fees cover all the work required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty). Stages of the purchase process

  • Taking your instructions and providing initial advice;
  • Opening your file, preparing your client care documentation and advising you on joint ownership, if applicable;
  • Check finance is in place to fund purchase and complete our Anti-Money Laundering checks;
  • Receiving the draft contract papers from the seller’s solicitors;
  • Submit all relevant searches;
  • Obtain further planning documentation, if required;
  • Investigation of title and raising all relevant and additional enquiries with the seller’s solicitor;
  • Consideration of mortgage offer (if relevant);
  • Give you advice on all documents and information received by way of a Report on Title;
  • Send final Contract to you for signature;
  • Agree a completion date (date from which you own the property);
  • Carry out exchange of Contracts and notify you that this has happened;
  • Post exchange and pre-completion work such as pre completion searches, drafting the transfer deed, raising requisitions on title, preparing completion statement and requesting the mortgage funds from the lender (if applicable);
  • Arranging for signing of transfer deed, mortgage deed and Stamp Duty Land Tax return;
  • Receiving the mortgage advance and any balance from you;
  • Completion of the purchase;
  • Post completion arranging the payment of the Stamp Duty Land Tax and registration of your ownership at HM Land Registry; and

In the case of Leasehold transactions, service notice of transfer and charge (if applicable), on your Landlord/Management Company.
